These terms explain how you can use HeyStream, what we provide, what you are responsible for, and how subscriptions, content, attendee data, and liability are handled. We have written them to be clear first, while still covering the standard legal terms a B2B software service needs.
If you need a signed enterprise agreement, a DPA, or additional contractual terms for your organization, please contact us before purchasing or renewing your plan.
- Paid plans renew automatically until you cancel, and plan limits apply based on your selected subscription or order form.
- You keep ownership of your content and audience data, but you must have the rights and permissions needed to use them in HeyStream.
- You must not misuse the platform, send unlawful or unsolicited communications, interfere with streams, or bypass usage limits.
- We may suspend or end access if use creates legal, security, abuse, or payment risk.
- Nothing in these terms limits rights that cannot be excluded under applicable law.
Scope and acceptance
These Terms of Service govern your use of the HeyStream website, accounts, plans, live streaming tools, registration pages, replay pages, CRM features, outbound messaging tools, and related services we provide.
By accessing or using HeyStream, you agree to these terms. If you use HeyStream on behalf of a company or other organization, you confirm that you have authority to bind that organization, and references to “you” include that organization.
If you have a separate written agreement, order form, or enterprise addendum with us, that agreement will control to the extent it conflicts with these terms.
Eligibility and accounts
You must provide accurate account information, keep your login credentials secure, and promptly update your details if they change. You are responsible for all activity that happens under your account and for making sure your team uses the service in line with these terms.
You must be legally able to enter into a binding agreement to use HeyStream. If we reasonably believe an account is unauthorized, insecure, or being used in a misleading way, we may require verification or restrict access.
Plans, trials, billing, and renewals
Some parts of HeyStream require a paid plan. Features, attendee caps, usage allowances, storage, destinations, and other limits are governed by the plan, pricing page, checkout flow, or order form that applies to your account.
If we offer a trial, the trial applies only for the period shown at signup or otherwise confirmed by us. Unless stated otherwise, paid subscriptions renew automatically for the same billing interval until cancelled. You can cancel future renewals through your billing settings or any other method we make available.
Fees are charged in advance unless we agree otherwise in writing. Except where required by law, fees are non-refundable once a paid period begins. If taxes apply, you are responsible for those taxes unless the law requires us to collect and remit them directly.
We may change pricing for future billing periods by giving reasonable notice. If you do not agree with a pricing change, your remedy is to cancel before the new price takes effect.
Acceptable use
You may use HeyStream only for lawful business purposes connected with your events, broadcasts, audience management, and related follow-up. You must not misuse the service, attempt to gain unauthorized access, interfere with availability, or use the platform in a way that harms us, our customers, or third parties.
- send unlawful, misleading, abusive, infringing, or unsolicited communications
- upload malicious code, probe security, reverse engineer protected parts of the service, or bypass technical restrictions
- use HeyStream to violate privacy, publicity, intellectual property, consumer protection, anti-spam, or sanctions laws
- impersonate another person or organization, or misrepresent your affiliation or authority
- use the service in a way that exceeds the limits of your plan or defeats fair-use protections without our written approval
Your content, audience data, and communications
You retain ownership of the content, branding, recordings, registration data, contact lists, and other material you submit to HeyStream. You give us a limited right to host, process, transmit, store, back up, display, and otherwise use that material only as needed to operate, secure, improve, and support the service.
You are responsible for making sure you have the rights, permissions, notices, and lawful basis needed for the content and personal data you put into HeyStream. That includes registrations, attendee data, CRM activity, email recipients, and any follow-up communications you send through the platform or its integrations.
If you use HeyStream to send emails, automate follow-up, or sync data into third-party tools, you remain responsible for the legality, accuracy, timing, and recipients of those actions.
Integrations and third-party services
HeyStream can connect with third-party tools such as CRMs, email providers, payment tools, streaming destinations, and other services. Your use of those third-party services is governed by their own terms and policies, not ours.
We are not responsible for third-party products, APIs, outages, policy changes, or data handling outside HeyStream. If an integration is removed, changed, or becomes unavailable, we may update or discontinue that integration without liability.
Our intellectual property
HeyStream, including its software, interface, documentation, branding, and underlying technology, is owned by or licensed to us and is protected by intellectual property laws. These terms give you a limited, non-exclusive, non-transferable right to use the service during your valid subscription or permitted access period.
You may not copy, sell, sublicense, distribute, modify, or create derivative works from the service except as expressly allowed by law or by our written permission.
Availability, changes, and support
We work to keep HeyStream available and secure, but we do not promise that the service will always be uninterrupted, error-free, or suitable for every use case. Streaming quality, third-party destinations, browser behavior, network conditions, and device capability can all affect performance.
We may update, improve, replace, or remove features from time to time. We may also perform planned or urgent maintenance. Where practical, we will try to give reasonable notice for material changes or scheduled maintenance that is likely to affect customers.
Suspension and termination
You may stop using HeyStream at any time. If you are on a paid plan, cancellation stops future renewals but does not undo charges already incurred for the current billing period unless the law requires otherwise.
We may suspend or terminate access immediately if you materially breach these terms, fail to pay fees when due, create security or legal risk, misuse the service, or if continued access could harm the platform, other users, or third parties.
On termination, your right to use HeyStream ends. We may delete or anonymize account data according to our retention practices, except where we are required or permitted to keep it by law, policy, or legitimate operational need.
Warranties and disclaimers
To the maximum extent allowed by law, HeyStream is provided on an “as is” and “as available” basis. We do not give any warranty that the service will be uninterrupted, error-free, compatible with every workflow, or that it will meet every business outcome you expect.
Any statutory rights you have that cannot legally be excluded remain unaffected. Nothing in these terms limits consumer rights or other mandatory protections that apply to you under law.
Limitation of liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot legally be excluded or limited.
Subject to that sentence, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profit, revenue, goodwill, anticipated savings, or data, even if the party knew such losses were possible.
Subject to the same exception, our total liability arising out of or related to these terms or the service will not exceed the total fees paid or payable by you to us for HeyStream in the 12 months before the event giving rise to the claim. If you have used only a free plan or free trial, our total liability will be limited to GBP 100.
Confidentiality
Each party may receive confidential information from the other in connection with the service. The receiving party must use that information only as needed to perform under these terms and must protect it with reasonable care.
This does not apply to information that is public through no fault of the receiving party, was already lawfully known, is independently developed, or must be disclosed by law or a valid legal process.
Privacy and data protection
Our handling of personal data is described in our Privacy Policy. If we process personal data on your behalf as a processor, the applicable data processing terms between us will govern that processing.
You are responsible for the legality of the personal data you collect, upload, or export through HeyStream and for providing any notices or consents required for your event attendees, contacts, presenters, customers, or team members.
Changes to these terms
We may update these terms from time to time. If we make a material change, we will post the updated version on this page and may also notify you by email, in-product notice, or another reasonable method.
Your continued use of HeyStream after the updated terms take effect means you accept the revised terms. If you do not agree, you must stop using the service and cancel any paid subscription before the new terms apply.
Governing law and disputes
These terms and any dispute or claim arising out of them or your use of HeyStream are governed by the laws of England and Wales, unless mandatory law in your place of residence requires otherwise.
If you are acting for a business, the courts of England and Wales will have exclusive jurisdiction over disputes arising out of or connected with these terms. If you are a consumer, you may also have the right to bring claims in the courts of your home jurisdiction where the law allows.
